Apple vs. Samsung: Who is Right?

I have been avoiding talking about the trial Apple vs. Samsung, but the details are too nice not to mention them. Nilay Patel is analyzing the past process where Apple filed against Samsung on grounds of how the latter’s terminal looks like and operates.

When it comes to „look” evidence is clear, but the other patents violated by Samsung have to receive confirmation from judge. Samsung, just like other important mobile phones manufacturers, has been copying iPhone from 2007 till today. It has often been written about „another iPhone Killer” that looks surprisingly similar to Apple terminals. Therefore, such a trial has an even more important stake: Apple is trying to prove that their patents are not just simple paper, but they can prevent other big companies from copying their products.

I, for one, am very curious to see how all this end (although I know it might take a few years) and how will Samsung and others innovate their interfaces, since they won’t be allowed to copy Apple. And we are not only talking about phones, but also about Samsung Galaxy Tab.

Check out the pictures and see for yourself. Who can deny that Samsung did not copy Apple? How many times have you heard mobile phone sellers or users saying: this looks like an iPhone?

“The sixteen specific claims Apple’s making against Samsung, as well as what it’s asking the court to do. Taken as a group, it feels like a remarkably solid case — Samsung can’t just up and countersue Apple with its own patents and hope to walk away with a handshake and a cross-license because of the various trademarks, trade dress, and design patent claims.

How the company decides to deal with those issues remains to be seen; there’s no question in my mind that Samsung designed TouchWiz to look and feel as much like iOS as possible, and then marketed it as such. (More than one of my friends has come back from a Verizon store with a Fascinate having been told that it’s “basically the same as an iPhone.”) says Nilay.

Oh and here is another interesting detail: Android showed that Google are smart. Apple does not have anything against Android (not in this case, at least), only devices manufacturers annoy them.

My tv could be like a Panasonic, a Sony or a Philips, but it is a Samsung! I hear nobody complain.. and my Mercedes A is almost simular to a Korean model, why complaining? Or is sales going down too much and ….a monopoly identical to Apple
