  • Financial Post Reports Apple Has More Liquid Cash Than US Government

    Apple has more money today than the U.S. government and there’s even crazy talk about how Steve Jobs might have to bail out Uncle Sam, the way that J.P. Morgan did in the mid-1890s. pple will share that hard-earned money from selling so many iPhones, iPads, iPod Touches, and Macs over many years, but stranger things have happened during financial panics over the years. The operating balance in Washington is at US$73.768 billion and Apple has US$75.876 billion……………

     

    Apple has more cash on its hands than the cash-strapped US government which is struggling to raise its debt limit before the August 3 deadline and avoid a default at the same time. Business Insider nails it down, saying “the world’s largest tech company has more cash than the world’s largest sovereign government”. Apple sat on a cash pile of $76.2 billion at the end of the June quarter, the sum which is comprised of cash, cash equivalents and marketable securities. Per this statement from the US Treasury, the government had an operating cash balance of $73.8 billion at the end of Wednesday, July 27. As Asymco’s Horace Dediu commented, Apple’s cash hoarde “is now nearly 16 percent higher than three months ago, the amount added last quarter is higher than the amount on hand 4.5 years ago and the cash added is higher than Google’s overall revenues in the quarter”. And unlike the US government, which owes a lot of money to creditors, Apple owes nothing to banks and has paid its debts in full when Steve Jobs re-energized the company back in the 1990s. It also helps that Apple does not pay dividends. Company executives suggested the company is stashing all this money for times of uncertainty and strategic acquisitions, which makes sense for a company that had once been so badly wounded that it was just 90 days from bankruptcy. So far, Apple’s been spending modestly and snapping up smaller startups rather than go all out with multi-billion dollar mergers and acquisitions, like its ex-pal Google.

  • Microsoft Has To Pay $70M To Alcatel-Lucent For Patent Infringement Claim Back In 2003

    Microsoft has been ordered to pay US$70 million to networking vendor Alcatel-Lucent in a years-old patent dispute that at one time could have cost Microsoft $1.5 billion and the suit was brought by Lucent in 2003, before it merged with Alcatel. The patent was originally applied for by engineers at AT&T, covers a method of entering information into fields on a computer screen without using a keyboard and an earlier trial involving the same parties found Microsoft guilty of infringing on that patent in the company’s Outlook e-mail software, Windows Mobile, and Microsoft Money…………….

     

    Microsoft must pay $70 million for infringing an Alcatel-Lucent patent used in versions of Microsoft’s Outlook program and two other applications and Alcatel-Lucent, France’s largest maker of telecommunications equipment, asked for as much as $75 million in damages. Microsoft’s lawyers asked jurors to limit the award to $5 million. The technology, called the Day patent was described in court during the as involving a touch-screen form entry and Microsoft argued it’s simply a date-picker function and isn’t used with e-mail, the most popular function on Outlook. Paris-based Alcatel-Lucent described the technology as a tool that “plays a central role in the entire operation” of Outlook. “Alcatel-Lucent is obviously pleased with the verdict and the jury’s recognition in the value of the Day patent that Microsoft infringed,” Luke Dauchot, a lawyer for Alcatel-Lucent, said after the verdict. A different jury in San Diego in 2008 found that Redmond, Washington-based Microsoft had infringed the patent and awarded $358 million in damages. An appeals court, upholding the infringement verdict, overturned the damages award, finding the calculation lacked sufficient evidentiary support. The case was sent back for retrial on damages only. We continue to maintain that current law requires a genuine apportionment of damages when the infringement is directed to a small feature of a feature-rich product,” David Howard, Microsoft’s deputy general counsel, said in an e-mail today. “We are reviewing the verdict in that light and considering next steps.” Dauchot told the jury in his closing argument the patent was “pervasive in the affected programs and helped provide “an easy, fast, reliable way of using Outlook.”Microsoft attorney Juanita Brooks told jurors that Alcatel- Lucent is trying to win money for a patent that is of little significance to Microsoft because the company’s patent portfolio was not making enough money.

  • Google Purchased 1K Patents From IBM To Save Android From Apple

    Google has purchased more than 1,000 patents from IBM in an effort to build up its intellectual property portfolio and possibly with an eye to fending off the increasing number of IP lawsuits the search giant faces from competitors such as Microsoft. The new purchase boosts Google’s intellectual property portfolio which currently has just 700 patents and the loss of Nortel patents was a big blow to Google as the search engine was willing to pay any price to beef up its bank of patents. IBM has just enough patents to give Google some ammunition to fend off lawsuits and Google can buy enough patents to put the lawsuit genie back in the bottle………….

     

    Google has purchased technology patents from International Business Machines (IBM) as the Web-search giant stocks up on intellectual property to defend itself against lawsuits. “Like many tech companies, at times we’ll acquire patents that are relevant to our business,” a Google spokesman said in a statement. The purchase was reported earlier by the blog SEO by the Sea, which said Google in mid-July recorded the acquisition of more than 1,000 patents with the U.S. Patent and Trademark Office. The patents involve the fabrication and architecture of memory and microprocessing chips, computer architecture including servers and routers and online search engines, among other things. SEO stands for search engine optimization or the practice of structuring websites and content so they rank well on search engines like Google. The Google spokesman declined to comment on the purchase price. It wasn’t immediately clear which of the patents might be useful to Google to shield against lawsuits. Google faces patent lawsuits for many of its services, including its Android mobile-device operating system, which has become a bigger target as its world-wide popularity has risen. It is unclear whether any current lawsuits pose a threat to future revenue generated by Google’s new technologies. Google has nearly $40 billion in cash, giving it the flexibility to make purchases. But it was outbid earlier this month when a coalition of companies that compete with Android, including Apple and Microsoft, agreed to buy a portfolio of some 6,000 patents owned by Nortel Networks Corp. for $4.5 billion. That price was five times the $900 million Google had initially offered in an early bid for the patents. Google, of Mountain View, Calif., has been in talks to buy InterDigital Inc., a company that owns thousands of patents and licenses them but doesn’t create products, people familiar with the matter have said. Such an acquisition would cost several billion dollars.

     Logitech Announces First Quarter Results for FY 2012
    Company Takes $34M Q1 Charge for Planned Price Reduction on Logitech Revue

    FREMONT, Calif., July 27, 2011 and MORGES, Switzerland, July 28, 2011 – Logitech International (SIX: LOGN) (Nasdaq: LOGI) today announced financial results for the first quarter of Fiscal Year 2012.

    Sales for Q1 FY 2012 were $480 million compared to $479 million in Q1 FY 2011. Excluding the favorable impact of exchange rate changes, sales declined by 4 percent year over year. The Company posted an operating loss of $45 million, compared to operating income of $12 million in the same quarter a year ago. Included in Logitech’s Q1 FY 2012 operating loss is a $34 million charge to cost of goods sold due to a planned price reduction on Logitech Revue with Google TV. The net loss for Q1 FY 2012 was $30 million ($0.17 per share) compared to net income of $20 million ($0.11 per share) in Q1 of FY 2011. Gross margin for Q1 FY 2012, reflecting the charge related to repricing of Logitech Revue, was 26.1 percent, down from 35.3 percent one year ago

    Logitech’s retail sales for Q1 FY 2012 were flat year over year, with an increase in Asia of 29 percent, an increase in the Americas of 1 percent, and a decrease in EMEA of 14 percent. OEM sales decreased by 16 percent. Sales for the LifeSize division grew 34 percent.

    In Q1, Logitech achieved strong growth in Asia, driven primarily by China. Also notable for the first quarter was continued sales momentum by the LifeSize division and a positive initial reception of the Company’s new tablet accessories.

    While Logitech is making progress in improving operations in the Company’s EMEA sales region, the Q1 performance reflects sustained weakness in the region. The Company also experienced minimal sales growth in its Americas region, primarily due to very weak sales in the Digital Home category. Logitech’s loss in Q1 was compounded by the significant impact of the decision to reduce the price of Logitech Revue from $249 to $99 during Q2. The action was taken with the goal of accelerating adoption of the Google TV platform by removing price as a barrier to broad consumer acceptance.

    In a separate announcement today, Logitech said that Chairman Guerrino De Luca has assumed the additional role of acting president and chief executive officer, succeeding departing CEO Gerald P. Quindlen.

    “I resume my former role as CEO, on an acting basis, with unwavering commitment to Logitech and strong confidence in the Company’s future and growth potential,” said Guerrino De Luca. “My priorities will be to pursue our many opportunities with a strong sense of urgency and to renew the confidence in Logitech among all stakeholders.”

    Outlook
    For Fiscal Year 2012, ending March 31, 2012, Logitech has lowered its sales outlook from approximately $2.6 billion to approximately $2.5 billion. The Company has lowered its FY 2012 target for operating income from approximately $185 million to equal to or greater than FY 2011 operating income of $143 million.

  • Motorola Solutions Reports Second-Quarter Hits By Sales Of $2.1 Billion

    Motorola Solutions, Inc. announced today their second-quarter 2011 results highlighted by sales of $2.1 billion, up 6 percent from the second quarter of 2010. Government segment sales were $1.3 billion, up 4 percent and $747 million for enterprise, up four and 11 percent from the year-ago quarter.     Motorola Solutions Reports Second-Quarter Results

    Motorola Solutions, Inc. (NYSE: MSI) announced today its second-quarter 2011 results highlighted by sales of $2.1 billion, up 6 percent from the second quarter of 2010 and driven by solid demand across both its Government and Enterprise segments.

    In addition, the company announced today that its board of directors has authorized the initiation of a regular quarterly dividend of $0.22 per outstanding share of the company’s common stock. The first dividend will be payable on Oct. 14, 2011, to shareholders of record at the close of business on Sept. 15, 2011. As part of a broader return of capital plan, the company’s board has authorized a share repurchase program of up to $2.0 billion through the end of 2012. The company may repurchase shares from time to time in the open market or in other privately negotiated transactions, subject to market conditions.

    Greg Brown, chairman and CEO of Motorola Solutions, said: “Our solid revenue growth and improved operating leverage further demonstrate the strength of our business. Based on this performance, we have raised our full year outlook. Additionally, the dividend and share repurchase program reinforce our commitment to return capital to shareholders while maintaining strategic flexibility.”

    GAAP operating earnings in the second quarter of 2011 were $170 million or 8 percent of sales, compared to $161 million or 8 percent of sales in the second quarter of 2010. GAAP earnings per share from continuing operations** were $0.17, compared to $0.01 in the second quarter of 2010.

    Non-GAAP*** operating earnings in the second quarter of 2011 were $315 million or 15 percent of sales, compared to $267 million or 14 percent of sales in the second quarter of 2010. Non-GAAP earnings per share from continuing operations were $0.57, compared to $0.37 in the second quarter of 2010. Non-GAAP financial information excludes after-tax benefits of approximately $0.40 per diluted share related to stock-based compensation expense, intangible assets amortization expense and highlighted items. Details on these Non-GAAP adjustments and the use of Non-GAAP measures are included later in this press release.

    During the second quarter of 2011, the company generated $102 million in operating cash flow from continuing operations. The company also retired $540 million in debt and ended the quarter with total cash* of $6.7 billion.

    Government segment sales were $1.3 billion, up 4 percent from the year-ago quarter. GAAP operating earnings were $111 million or 8 percent of sales compared to $117 million or 9 percent of sales in the year-ago quarter.     Results from Discontinued Operations

    Second-quarter net earnings from discontinued operations were $291 million, which substantially relate to operations of the Networks business that Motorola Solutions sold to Nokia Siemens Networks on April 29, 2011 for net cash proceeds in excess of $1 billion.

    Third-Quarter and Full Year 2011 Outlook

    The company expects to see growth across both government and enterprise segments. Third-quarter sales are expected to grow between 7 and 8 percent over the third quarter of 2010 with EPS from continuing operations of $0.56 to $0.61. This outlook excludes stock-based compensation expense, intangible assets amortization expense and charges associated with items of the variety typically highlighted by the company in its quarterly earnings releases. The company now expects full-year revenue growth of 5.5 to 6 percent with operating earnings of approximately 16.5 percent of sales.

  • Sprint Make Partnership With LightSquared

    Sprint and LightSquared have signed a network-sharing deal that promises to transform the 4G wireless landscape and for the wireless carrier, LightSquared gives Sprint an option for LTE. The LightSquared deal falls under Sprint’s Network Vision plan and Sprint said it will outline its 4G strategy Oct. 7 at its investor day.     LightSquared enters into a Spectrum Hosting and Network Services Agreement with Sprint that is expected to result in substantial savings for LightSquared and accelerate completion of LightSquared’s nationwide 4G-LTE network. Sprint has option to purchase 4G capacity from LightSquared and they announced that they ave entered into a 15-year agreement that includes spectrum hosting and network services, 4G wholesale and 3G roaming. This spectrum hosting arrangement leverages Sprint‘s investment in its innovative, multi-year Network Vision plan. Under the agreement, LightSquared will pay Sprint to deploy and operate a nationwide LTE network that hosts L-Band spectrum licensed to or available to LightSquared. As a wholesale-only carrier with separate core network operations, LightSquared can sell its 4G broadband capacity produced through this spectrum hosting relationship to Sprint, other wireless carriers, and retail partners. Under the terms of the agreement, during an 11 year period, LightSquared will make payments to Sprint of approximately $9 billion in cash for spectrum hosting and network services as well as LTE and satellite purchase credits which are currently estimated to be valued at approximately $4.5 billion. The agreement also provides Sprint the opportunity to purchase up to 50 percent of LightSquared‘s expected L-Band 4G capacity. The wholesale purchase credits will provide Sprint the option to obtain cost-competitive access to 4G capacity by offsetting Sprint‘s purchases of 4G capacity from LightSquared, should Sprint elect to incorporate the L-Band LTE capability as part of its 4G offering.

     

    This agreement is expected to lower network capital and operating expenses for LightSquared by more than $13 billion over the next eight years in comparison with the cost of a stand-alone network build. LightSquared expects the deployment of the nationwide 4G-LTE network to be completed more than one year ahead of the Federal Communications Commission (FCC) mandate to cover 260 million Americans by 2015. LightSquared has also entered into a 3G nationwide roaming agreement with Sprint. With access to Sprint’s 3G nationwide network, LightSquared‘s wholesale customers will be able to offer combined 4G/3G data services as soon as LightSquared launches its first 4G markets in 2012. “This spectrum hosting agreement with LightSquared allows Sprint to more efficiently use its Network Vision platform,” said Steve Elfman, president of Network Operations and Wholesale for Sprint. “In addition to improving our cash flow, it provides additional options and flexibility in how we meet our customers’ future capacity needs.” “This agreement gives LightSquared a rapid and cost-effective radio access network build,” said LightSquared Chairman and CEO Sanjiv Ahuja. “With our next generation satellite already operational and our independent core network build underway, LightSquared is now well positioned to meet the fast-growing market demand for wireless broadband services with its wholesale-only integrated 4G-LTE and satellite network.” The agreement is subject to LightSquared‘s obtaining resolution and FCC approval of certain interference issues involving terrestrial use of the L-Band spectrum.

  • InterDigital Sues Nokia, Huawei And ZTE For 3G Patent

    InterDigital has filed a complaint with the U.S. International Trade Commission against Nokia, Huawei Technologies and ZTE accusing the cellphone makers of infringing seven InterDigital technology patents and the hammer’s been forged from seven patents for various WCDMA and CDMA2000 technologies allegedly found in those companies phones, broadband dongles and tablets. InterDigital said it has tried to negotiate licensing deals with the companies but has failed to reach an acceptable resolution and InterDigital has around 1,400 U.S. patents but claims to have a patent portfolio of 19,000 issued patents and patent applications worldwide…………

     

    InterDigital announced that its wholly-owned subsidiaries InterDigital Communications, LLC, InterDigital Technology Corporation and IPR Licensing, Inc. (collectively, “InterDigital“) have filed a complaint with the U.S. International Trade Commission (“ITC”) against Nokia Corporation and Nokia Inc. (collectively, “Nokia“), Huawei Technologies Co., Ltd. and FutureWei Technologies, Inc. d/b/a Huawei Technologies (USA) (collectively, “Huawei”) and ZTE Corporation and ZTE (USA) Inc. (collectively, “ZTE” and together with Nokia and Huawei, “Respondents”). The complaint alleges that the Respondents have engaged in unfair trade practices by making for importation into the United States, importing, and selling after importation, certain 3G wireless devices, including WCDMA and cdma2000 mobile phones, USB sticks, mobile hotspots, and tablets, and components of such devices that infringe seven of InterDigital’s U.S. patents. The action also extends to certain WCDMA and cdma2000 devices incorporating WiFi functionality. In conjunction with the ITC filing, InterDigital has also filed a complaint in the United States District Court for the District of Delaware alleging that Respondents’ 3G wireless devices infringe these same InterDigital patents.”Over the past thirty years, InterDigital has invested nearly one billion dollars in the development of advanced digital cellular technologies, creating important innovations, and helping to drive an industry creating billions of wireless connections”

     

    InterDigital’s complaint with the ITC seeks an exclusion order that would bar from entry into the U.S. any infringing 3G wireless devices (and components) that are imported by or on behalf of Respondents, including wireless mobile phones, USB sticks, mobile hotspots, and tablets capable of operating with a 3G WCDMA or 3G cdma2000 system. InterDigital’s complaint also seeks a cease and desist order to bar further sales of infringing products that have already been imported into the United States. The complaint asserts U.S. Patent Nos. 7,349,540, 7,502,406, 7,536,013, 7,616,970, 7,706,332, 7,706,830, and 7,970,127. “Over the past thirty years, InterDigital has invested nearly one billion dollars in the development of advanced digital cellular technologies, creating important innovations, and helping to drive an industry creating billions of wireless connections,” said Lawrence Shay, President of InterDigital’s patent holding subsidiaries. “During that period, we have signed dozens of license agreements with manufacturers, giving them access to a patent portfolio of approximately 19,000 issued patents and patent applications – among the largest wireless portfolios in the world,” continued Shay. “The vast majority of our agreements have been reached without the need for litigation. However, despite having engaged in good faith efforts to license our patents to Nokia, Huawei and ZTE, we have not been able to reach an acceptable resolution. As a result, to protect our intellectual property and the interests of our licensees, we made the decision to bring legal action against these parties.” By statute, the ITC has 30 days from the filing of the complaint to decide whether to formally institute an investigation. As of June 30, 2011, the company’s patent portfolio consisted of approximately 1,400 U.S. patents and approximately 8,000 non-U.S. patents. In addition, as of June 30, 2011, the company had approximately 1,250 pending applications in the U.S. and approximately 8,250 pending non-U.S. patent applications. The patents and applications comprising the company’s portfolio relate predominantly to digital wireless radiotelephony technology (including, without limitation, 2G, 3G, and 4G technologies).

  • Qualcomm Adding Gesture Recognition IP

    Qualcomm acquires gesture recognition IP from GestureTek and moving into the gesture recognition field with the recent purchase of some of GestureTek’s assets. The motive for Qualcomm is to integrated gesture recognition technology into its current and next-generation Snapdragon processors and it could be one that signals a shift in the way chip makers are looking out for themselves.     Qualcomm Incorporated announced that it has acquired certain assets from GestureTek, a developer of gesture recognition technology. A leader in the gesture recognition field, GestureTek has more than 25 years of experience implementing gesture-based technologies in mobile devices, entertainment facilities, healthcare systems, retail locations, and public and private venues. The acquisition gives Qualcomm ownership of certain intellectual property assets related to gesture recognition, as well as key engineering resources.
