Judge Asks Apple To Announce That Samsung Didn’t Copy iPad

Last week, Apple started sending letters to US carriers and retailers to stop selling Samsung Galaxy Tab and Galaxy Nexus in the country because of a court injunction issued over infringement complaints. But, Apple has to follow a completely opposite course in UK. It has to publish a notice that Samsung didn’t copy designs from Apple’s iPad, after the former lost a lawsuit against the latter.

We reported earlier that a judge in UK announced, since Samsung’s tablets did not look as cool as iPad, Samsung didn’t copy Apple’s iPad. The court pretty much exonerated Samsung of the charges of design infringement. Not only that, the judge has now ordered Apple to post a notice on its UK website as well as the British newspapers saying that Samsung didn’t indeed rip off Apple’s design.

This new announcement has been made by Judge Colin Birss. The Judge asked Apple to explain the court’s decision on July 9 through the notice. The notice will be posted on Apple’s UK website for a total of six months and Apple will have to get it published in a number of newspapers, magazines and other publications.

Essentially, since Samsung is found innocent of infringement charges, the burden comes on Apple in the form of defamation charges. And to save Samsung’s image which has been distorted by Apple’s repeated claims against Galaxy Tab, the court has ruled this. Apple’s lawyers tried to respond by saying that publishing such a notice would seem as if Apple is advertising its very rival. But the court dismissed the objection.

Given its win in the case, Samsung tried to ask the court to block Apple from issuing any further statements against Samsung. However, the court refused, stating that to issue statements and express their opinion is Apple’s right.
