Apple Claims Samsung ‘Slavishly’ Copied Its Trademark Icons

The legal battle Samsung and Apple is taking a rather ridiculous turn. Apple and Samsung were to meet in front of the court this week to continue their legal tussle which has come to focus on a few things. During the course of the case, Apple has been forced to reveal a lot about its business, things that it keeps close to itself.


Now, apart from directly accusing Samsung of infringing many design patents, Apple claims that Samsung has also ‘slavishly’ copied its trademark icons.

To cite this, Apple has provided different icons in iOS, such as the icon of telephone calls, contacts, notes, photos and settings. Along with it, Apple has provided comparisons from different Samsung devices which do indeed show a close resemblance. However, it’s hard to say whether or not this can be pitched as a copyright infringement.

According to Apple, “Samsung is also infringing Apple’s icon trademarks by advertising and selling a wide variety of products using confusingly similar icons…The icons on these products were intentionally designed to look like Apple’s icons and infringe Apple’s trademark rights.”

Samsung lawyers, on the other hand, have argued that although the inspiration for Samsung’s icons may have come from Apple, Samsung has a long history of innovation and there is no way Samsung would have copied these icons directly from Apple. Let’s see what the jury thinks about this.
