Samsung and Ericsson have been locked in a legal battle since the past few years. The original feud had started when Ercisson had claimed that Samsung was using its patents without paying for them. Samsung had launched a counter-suit and is now seeking from ITC to ban several Ericsson products.
Ericsson has been quite true in its claims. Samsung does indeed make use of its patents without its permission and continues to do so. So, the case between the two has essentially hinged on the exact terms on which these patents ought to be licensed.
Ericsson claims that it has offered the same licensing fees and terms to Samsung as it does to other vendors using its patents. Samsung, on the other hand, is of the view that the fees demanded by Ericsson are too high and must be lowered.
Negotiations between the two companies recently broke down which then led Ericsson to request a ban on several Samsung products in the U.S. Now, to reciprocate that, Samsung has also requested from ITC to ban several Ericsson products over alleged patent infringement.
The move by Samsung is, naturally, meant to pressurize Ericsson into signing the licensing deal on Samsung’s terms. Ericsson has not relented so far and is of the opinion that if it offers Samsung a deal involving lower fees, that will given the Korean electronics maker an unfair advantage over other vendors using the same Ericsson patents.
