Oracle is seeking $2.6 billion in damages from Google as part of its patent infringement lawsuit over Java and in the latest filing in the case between the two California tech giants, Oracle revealed it was seeking $0.9 billion to $1.4 billion upfront from Google for infringing its patents. Oracle is entitled to damages based on a number of grounds, including advertising revenues from Android phones and Android has been used on more than 310 devices and now has the largest share of the smartphone market……….
An expert hired by Oracle Corp. as part of its litigation with Google Inc. has estimated that Oracle should be awarded $2.6 billion as a result of Google’s alleged infringement of Oracle intellectual property in its Android mobile-phone software. The figure from the Oracle expert, Iain Cockburn, was included in a court filing on Tuesday. Previous filings had indicated that Oracle was seeking billions of dollars in damages from Google in the case, though a precise number was not known. Cockburn is a finance professor at Boston University. “Google falsely claims that Prof. Cockburn concludes that Oracle is owed anywhere from $1.4 to $6.1 billion in damages,” Oracle said in the court filing Tuesday. “He does not. His opinion is that the total damages that should be awarded to Oracle is $2.6 billion.” Oracle and Google have been contesting the damages estimates by Cockburn, with Google arguing in previous filings that they are “unreliable” and “inappropriate.” Oracle filed suit against Google in U.S. District Court in San Francisco in August, arguing that Google’s Android software infringes on patents and copyrights associated with Java, a software originally developed by Sun Microsystems. Oracle closed its acquisition of Sun early last year. Android is built on an open source model that uses contributions from outside developers and it has attracted a number of lawsuits, though most often targeted at the makers of phones that use Android. A version of Oracle’s Java software called Java ME is widely used in lower-end, “feature” phones, while Android is prevalent in so-called smartphones.
