The legal battle between the technology king, Apple and many other tech giants is unending. While Apple is already entangled in a number of legal suits with other major companies, Motorola has now demanded to hand over 2.25% of it’s overall sales to Motorola. Why? Because Motorola has accused Apple of using it’s FRAND patents. The case of the use of FRAND patents is still in the court and because of it, Apple has been forced to remove a number of it’s products from the German market.
Motorola is now asking Apple to give it 2.25% of the overall sales, which amounts up to a really huge amount. The reason why Motorola is asking for such a huge amount is that the company thinks Apple has used it’s FRAND patents in a number of products and has earned a huge profits from them.
But is that claim right? That is still to be decided in the German courts where the legal battle is on. Apple already has been forced to remove a number of it’s product from the German market because of this case by Motorola. So how is Apple planning to defend this case? According to the latest blog post on FOSS patents blog, Apple is trying to show the court that the patent cross-license agreement between Qualcomm and Motorola. If this is admitted by the court, this can really strengthen the case.
Meanwhile, Apple tried to reach a deal with Motorola and asked it the amount it would charge for the royalty of the specific patents in question. Motorola demanded 2.25% of the overall sales which well exceeds billions. Perhaps that is the reason why Apple is not up for settlement on those terms and is continuing to pursue the case in the court.
