Kim Dotcom is the very person who was the life and soul of MegaUpload and the one person that the US authorities are craving to lay their hands on, over charges of copyrights infringements and a whole lot more. The irony of the whole situation is that while Dotcom is considered the ‘King of Pirates’, he has now accused FBI of pirating his data out of New Zealand.
The data that has been recovered from Kim Dotcom’s computers was cloned by FBI and was then set over to U.S. This was being done merely days after a judge said that a court hearing must be undertaken to see whether or not FBI should be allowed to take the recovered material.
While courts in the New Zealand seem pretty impartial to the desires of U.S government, the regime may not extend the same impartiality to Dotcom. While defending the actions of FBI agents, Crown lawyer John Pike admitted that the data has been sent overseas but that this was perfectly legal.
Pike’s stance was that the only things that couldn’t be sent overseas was material things recovered and that what FBI agents recovered from Dotcom’s computers was information.
However, if indeed it is found that FBI agents sent over the data in violation of the legal rights of Dotcom, this would directly have the FBI agents in for Contempt of Court. According to an intellectual property lawyer, “Assuming the US authorities complied with that order and returned the clones without keeping any copies, that might make it more difficult for them to prosecute the case in the US but it will not have any impact on the extradition proceeding here in New Zealand.”
