Apple has been able to secure a major victory against Samsung in a recent case where the jury has ruled that Samsung must pay Apple $1 billion in damages. The jury found Samsung to have infringed Apple’s design patents, which also include rounded corners. Google seems to be baffled over this.
Google’s surprise may be fairly well-founded since many tech analysts have been shocked as well. Design patents normally refer to more general design features which are exclusive and unique. But Apple has been able to patent ’rounded corners’, a feature which is by no means new and has been used in device before iPhone and iPad.
Nonetheless, the jury found Apple’s case convincing. And that can unlock a slew of many new cases based on petty design features. Google’s VP of corporate development, David Lawee, said in a recent interview, “We didn’t believe rounded corners were patentable.”
Lawee goes on to say that if that was possible indeed, Google now regrets that it didn’t patent a lot of its intellectual property. By Apple’s argument, every tech giant can patent petty design features and go on to cite them as intellectual property. Google could have done this, given the sheer vastness of its intellectual property but it didn’t.
