Copyright Office of the U.S. Library of Congress had introduced two critical exceptions to the DMCA, which makes it legal for users to jailbreak and unlock their iPhone in the US.Cult of Mac have reported that Apple has issued an official response to the new federal policies on jailbreaking and unlocking iPhone.
The company maintains that whether jailbreaks are legal or not, they can still void the warranty on your iPhone. (As Victor Agreda points out at TUAW, “can void the warranty” doesn’t mean it always does. We don’t know whether there will be exceptions in practice.)
Apple’s spokesperson provided Cult Of Mac the following statement:
Apple’s goal has always been to insure that our customers have a great experience with their iPhone and we know that jailbreaking can severely degrade the experience. As we’ve said before, the vast majority of customers do not jailbreak their iPhones as this can violate the warranty and can cause the iPhone to become unstable and not work reliably.
This is in line with the support document where Apple has cautioned users against jailbreaking their iPhone, iPad or iPod Touch.As we had mentioned earlier, this doesn’t change things much for iPhone users as the cat and mouse game between Apple and the iPhone hacking community will continue but from a legal point of view they can now jailbreak their iPhone without fear of copyright infringement penalties.
Apple has always maintained that they wouldn’t provide support for jailbroken devices, but they’ve never gone after the folks who publish jailbreaking code or run alternative app stores like Cydia. With 10 million jailbroken iPhones out there, developers who are rejected from the official App Store might increasingly turn to these now-legal alternatives.

When someone says “X *can* do Y” that means it’s not impossible for X to do Y, not that X actually does or will do Y. In fact, in the United States, Apple cannot legally void your warranty just for jailbreaking. If they could, every car manufacturer would void your warranty if you had your oil change done anywhere but at one of their dealers.
